Welcome to Mystery Pull! These Terms of Service ("Terms") govern your use of mystery.productsagecollectibles.com (the "Website"), operated by Product Sage Collectibles, DBA Mystery Pull ("we," "us," or "our").

By using our Website or purchasing a mystery pull, you agree to these Terms. If you do not agree, please do not use our services.

1. Eligibility

You must be at least 18 years old to use this Website and purchase a mystery pull. By completing a purchase, you affirmatively represent that you are at least 18 years of age. If you allow a minor to use your device, account, or payment method, you accept full personal financial responsibility for all resulting charges. Purchases made by minors are unauthorized, and we reserve the right to void such transactions without refund.

2. Account and Email Verification

To make a purchase, you must verify your identity using a One-Time Password (OTP) sent to your email address. You are solely responsible for maintaining the security of your email account and for all activity that occurs under your profile. The successful entry of an OTP constitutes authorization of the transaction by the account holder. Claims of unauthorized access must be reported within 72 hours of the transaction and may require supporting evidence. We log IP addresses and timestamps for all transactions.

3. Purchase Terms

Each Mystery Pull is a purchase of a real, physical collectible. The specific item you receive is allocated from the available pool based on the series distribution method. Every pull guarantees you will receive a genuine, physical item.

Payments are securely processed via Stripe. We accept major credit and debit cards and other payment methods supported by Stripe, including Apple Pay and Google Pay where available.

All mystery pull purchases are final and non-refundable. The transaction is fully consummated at the moment your pull is generated, regardless of whether you view the reveal animation. We do not offer refunds, returns, or exchanges. By completing a purchase, you acknowledge that: (a) you are purchasing a mystery item and may receive any item from the available pool, including the most common tier; (b) you have reviewed and accepted the odds displayed on the series page; and (c) you agree to contact our support team before initiating any bank dispute. Bad-faith or fraudulent payment disputes may result in account suspension and collection efforts for the disputed amount plus associated fees.

4. Item Condition

All items included in our mystery pull series meet our Standard condition tier, suitable for a collector's shelf. Items are sourced from authorized distributors and maintained in proper storage. Because collectibles are factory-produced, mass-manufactured goods, minor variations including slight paint differences, small box creases, minor window scratches, and factory glue residue are inherent to the product and are not considered defects.

We reserve sole discretion in determining whether an item meets our Standard condition threshold. Item condition is not guaranteed to meet any specific third-party grading standard (e.g., AFA, CGC, PSA). Subjective disagreements over collectible condition are not grounds for a refund, return, exchange, or "Not As Described" dispute.

5. Item Allocation and Odds

Items are allocated from the available pool for the active series based on the series distribution method. The tier breakdown displayed on the series page reflects the overall composition of the pool and is not a per-pull probability guarantee. As items are pulled, the pool composition changes and displayed figures may shift accordingly.

Estimated item values shown on our Website are based on third-party pricing engines such as Pop Price Guide (PPG) and similar sources at the time the item was added to our inventory. Because the collectibles market fluctuates, we do not guarantee the current or future secondary market value of any item. You acknowledge you are purchasing a mystery collectible, not an investment vehicle.

6. Trade-In and Site Credit

After revealing your pulled item, you may choose to keep it for physical shipping or trade it in for site credit on eligible items. Trade-in values are calculated at our sole discretion and may vary based on the item's estimated market value at the time of the offer, eligibility, rate settings, and disclosed trade-in fees. Not all items are eligible for trade-in offers. Trade-in offers are final and non-negotiable once presented. The credit amount shown before acceptance is the amount credited to your Mystery Pull balance. If you decline an offer, you may keep the physical item for shipping.

Site credit can be used for future mystery pulls on Mystery Pull or converted into a gift card redeemable at productsagecollectibles.com. Site credit and gift cards have no cash value and cannot be redeemed for cash, transferred to another person, or refunded to your original payment method, except where required by applicable state law.

Site credit balances do not expire, subject to applicable state laws. We reserve the right to modify the trade-in program, rates, and eligibility criteria at any time.

7. Shipping and Fulfillment

If you choose to keep your pulled item, we will ship it to the address you provide via USPS or UPS. Processing and shipping times are estimates and may vary. Higher-value items may ship with signature confirmation at our discretion. Higher-value items may also require additional processing, handling, and fulfillment time.

Risk of loss and title for items pass to you upon our delivery to the shipping carrier (FOB Origin). For items shipped without signature confirmation, carrier delivery confirmation constitutes proof of delivery. For items requiring signature confirmation, the signature constitutes proof of delivery. Any claims for lost or damaged packages must be filed directly with the carrier. We are not responsible for packages lost, stolen, or damaged after carrier acceptance, and such events are not grounds for a refund or chargeback. You agree that carrier tracking data and delivery confirmation are sufficient evidence of delivery for purposes of any payment dispute. We may, at our sole discretion, assist with carrier claims on a case-by-case basis, but are under no obligation to do so.

8. Fulfillment Errors

If you receive an item that is materially different from what was allocated to your pull (i.e., the wrong product entirely), please contact us within 7 days of delivery with photographic evidence. Verified fulfillment errors will be corrected at our expense. This section applies only to cases where the wrong product was shipped, not to subjective disagreements about item condition, value, or rarity.

9. User Conduct

You agree not to:

  • Use any automated scripts, macros, browser extensions, bots, or unauthorized APIs to interact with the Website or make purchases
  • Attempt to manipulate, exploit, or abuse the trade-in, credit, or offer system
  • Create multiple accounts to circumvent purchase limits, restrictions, or promotions
  • Interfere with the operation of the Website or other users' experience
  • Misrepresent your identity or age
  • File fraudulent chargebacks or payment disputes

Violations may result in, at our sole discretion and without prior notice: (a) account suspension; (b) permanent termination; or (c) forfeiture of site credit and pending offers as described in Section 16. Our determination of a violation is final. We identify multi-accounting using IP tracking and payment pattern analysis.

10. Intellectual Property

All original content, branding, and design on this Website are the intellectual property of Product Sage Collectibles. "Funko," "Funko Pop!," "Funko Soda," and related marks are registered trademarks of Funko, LLC. Product Sage Collectibles is an independent retailer and is not affiliated with, endorsed by, or sponsored by Funko, LLC.

11. Disclaimer of Warranties

The Website and all items are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the Website will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, Product Sage Collectibles shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Website or any purchase. You expressly waive any claims for "loss of expected value," secondary market value, or speculative damages. Our total aggregate liability for all claims arising from your use of the Website shall not exceed the total amount you paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Product Sage Collectibles and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Website, violation of these Terms, or infringement of any third-party rights.

14. Per-Transaction Acknowledgment

By clicking "Pull Now," "Purchase," or any similar confirmation button, you reaffirm your agreement to these Terms, including the no-refund policy, assumption of risk, and all applicable disclaimers. Each transaction constitutes a separate, binding agreement to these Terms as applied to that specific purchase.

15. Dispute Resolution

If you have a concern, please contact us first at the email below so we can attempt to resolve it informally. You must allow us at least 15 business days to resolve any issue before initiating a payment dispute, arbitration demand, or legal proceeding.

If we cannot resolve the dispute informally, you agree that any legal claims will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You agree to waive any right to participate in a class-action lawsuit against Product Sage Collectibles. Either party may bring claims in small claims court in the State of Florida for disputes under $5,000 as an alternative to arbitration. If 25 or more similar arbitration demands are filed with the assistance of the same law firm or coordinated group, arbitrations will proceed in batches of 25.

You may opt out of this arbitration agreement by emailing us within 30 days of your first purchase. If any part of this arbitration agreement is found unenforceable, the remainder shall continue to apply. These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

16. Account Termination

We may suspend or terminate your account at our sole discretion for violations of these Terms, suspected fraudulent activity, or bad-faith chargeback filing. Upon termination for cause, all remaining site credit and pending trade-in offers are permanently forfeited. Physical items already allocated to your account will be shipped to your address on file or, if no valid address exists, held for 30 days before being returned to inventory. "For cause" includes but is not limited to: fraudulent chargeback filing, multi-account creation, bot usage, trade-in abuse, and any conduct we reasonably determine violates these Terms. If we terminate your account without cause, we will convert your remaining balance to a gift card redeemable at productsagecollectibles.com within 30 business days.

17. Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to supplier shortages, shipping disruptions, natural disasters, government actions, internet outages, third-party payment processor failures, cloud hosting interruptions, or cyber-attacks.

18. Changes to These Terms

We may update these Terms at any time. The most current version will be posted on this page with an updated "Last updated" date. For material changes, we will notify you via email at least 14 days before the changes take effect. Your continued use of the Website or any purchase after the effective date constitutes acceptance of the updated Terms. If you do not agree with updated Terms, your sole remedy is to stop using the Website.
